Yahoo news is reporting that a Detroit woman serving on the jury of a felony criminal case was booted after the defense attorney’s son found she had posted that the client was “guilty” on her Facebook page. The problem was the case wasn’t actually over.
Something that I want to stress again to attorneys who participate in jury trials is that jurors go home and get on the internet to search for lawyers and information related to their trial. In fact, one jury consultant estimated that as many as 50% of jurors searched the web for related information during the trial.

A recent front page story in the business section of The New York Times suggests that Microsoft and its year-old search engine, Bing, are giving Google reason to look over their shoulder. While Google still has a sizable lead over Bing in the number of total web searches, 62.6% to 12.7%, Bing is steadily gaining ground. Yahoo, another big player in the search engine game, holds nearly 20% of Web searches, also gaining ground on Google in the last year. In the last 12 months Bing and Yahoo inked a search partership, finally giving Microsoft a real piece of the total search market share.
The Times article claims that “young people and women have shown a particular fondness for Bing” and attributes much of this fondness to the overall look and feel of Bing’s main page. Google, without giving credence to their competition, appear to be nervous about their losses. In recent months, they have changed or added features that closely mimic many of the popular features associated with Bing, including left-handed navigation tools, the option for a colorful background image, travel tools that track and predict fluctuations in flight prices, as well as offering more tie-ins to popular social networking sites.
Danny Sullivan, editor in chief of the blog Search Engine Land, thinks Google may be overreacting and “seems to do things because Bing has done something. Whether Google’s changes will hold off the rise of Bing remains to be seen. What is for certain is that Microsoft has finally made some headway in its desire for a greater share of the Web search market.

For the third year in a row Law Father was a ‘Silver Sponsor’ of the Colorado Trial Lawyers Association Spring Dinner.
